CREATOR TERMS OF SERVICE

1. INTRODUCTION AND ACCEPTANCE OF TERMS

These Creator Terms of Service (“Creator Terms”) form a legally binding agreement between you (“Creator,” “you,” or “your”) and Qlipps (“Qlipps,” “Company,” “we,” “us,” or “our”), governing your use of the platform available at https://qlipps.com (the “Platform”) as a content creator.

By creating a Creator account, uploading content, or enabling monetization features, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms, along with all related policies incorporated herein, including the general Terms of Service, Privacy Policy, and Community Guidelines. Continued use of the Platform constitutes ongoing acceptance of any updates to these Terms.

2. ELIGIBILITY, AGE STRUCTURE, AND ACCOUNT REQUIREMENTS

Qlipps operates a dual-tier access system, distinguishing between general users and content creators.

2.1 General Users (Ages 13–17)

Users aged between 13 and 17 may access the Platform only under parental or legal guardian supervision. Such users are restricted to non-adult content and are strictly prohibited from accessing, subscribing to, or interacting with Adult Content in any form. Qlipps implements age-gating mechanisms and access controls to enforce these restrictions.

2.2 Creator Eligibility (18+ Requirement)

To register as a Creator, you must be at least 18 years old and legally capable of entering into binding agreements. By registering, you represent and warrant that you meet this requirement. Any attempt to create or operate a Creator account while under the age of 18 constitutes a material breach of these Terms.

2.3 Identity Verification (KYC Compliance)

Before accessing monetization features, Creators must complete identity verification procedures. This may include submission of government-issued identification, biometric verification, and payment account validation. Qlipps reserves the right to request additional documentation at any time and to suspend or terminate accounts that fail verification or provide inaccurate information.

3. CREATOR MONETIZATION MODELS AND EARNINGS

Qlipps provides a hybrid monetization ecosystem, enabling Creators to earn revenue through multiple channels.

3.1 Free and Advertisement-Based Content

Creators may upload content that is freely accessible to users and generate revenue through advertisements served by the Platform. However, monetization eligibility is subject to advertiser-friendly content standards. Content that does not meet these standards may remain visible but may not generate advertising revenue.

3.2 Subscription-Based Profiles

Creators may offer subscription-based access to their content, allowing users to pay recurring fees for exclusive or premium content. Creators are responsible for clearly communicating the scope, pricing, and benefits of such subscriptions.

3.3 Pay-Per-View (PPV) Content

Creators may charge one-time fees for access to specific content. This includes premium videos, private content, or exclusive releases. Pricing must be transparent and must not mislead users.

3.4 Adult and Private Content

Qlipps allows Adult Content within designated categories, provided that such content is properly labeled and restricted to verified users aged 18 and above. Creators are solely responsible for accurate categorization and compliance with all applicable laws. Adult Content may be monetized through subscriptions, PPV, and, where permitted, advertising.

4. PLATFORM FEES, PAYMENTS, AND PROCESSING

Creators agree to the following financial terms:

4.1 Platform Fees

Qlipps charges a standard platform fee of ten percent (10%) of gross Creator earnings. This fee covers hosting, distribution, payment facilitation, and platform services.

4.2 Payment Processing Fees

Additional fees are charged by third-party payment processors, typically amounting to approximately three percent (3%) plus a fixed transaction fee. These fees are deducted from Creator earnings.

Payments are processed through providers such as Stripe and PayPal. Creators agree to comply with the terms of these providers.

4.3 Payouts and Withholding

Qlipps may establish payout schedules, minimum payout thresholds, and reserve balances. The Company reserves the right to delay, withhold, or offset payouts in cases involving fraud, disputes, legal obligations, or policy violations.

5. CHARGEBACKS, REFUNDS, AND PAYMENT DISPUTES

Due to the nature of digital and subscription-based services, payment disputes and chargebacks may occur. By using the Platform as a Creator, you agree to the following:

  • If a user initiates a chargeback or refund, the corresponding earnings may be reversed, including any associated fees or penalties imposed by payment processors.
  • Qlipps reserves the right to deduct disputed amounts from your current or future earnings.
  • If your account balance is insufficient, a negative balance may be recorded and recovered from future payouts.
  • Excessive chargebacks or refund activity may result in monetization restrictions, increased review scrutiny, or account termination.

Creators are expected to minimize disputes by accurately representing their content and pricing.

6. CONTENT OWNERSHIP AND PLATFORM LICENSE

Creators retain ownership of their content. However, by uploading content, you grant Qlipps a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, distribute, publicly display, and promote your content.

This license enables Qlipps to operate the Platform, recommend content, market the service, and optimize performance. The license continues for as long as the content remains on the Platform and for a reasonable period thereafter for operational purposes.

7. CREATOR RESPONSIBILITIES AND CONTENT COMPLIANCE

Creators are solely responsible for all content they upload and must ensure that such content:

  • Is lawful, accurate, and not misleading
  • Does not infringe any third-party intellectual property or privacy rights
  • Includes valid consent from all participants
  • Is properly categorized, especially in the case of Adult Content

Any violation may result in removal, demonetization, or account termination.

8. ADULT CONTENT COMPLIANCE AND 2257 REQUIREMENTS

Creators who upload Adult Content must comply with all applicable laws, including 18 U.S.C. § 2257.

This includes:

  • Verifying that all individuals appearing in the content are at least 18 years old at the time of production
  • Maintaining accurate records of identification, consent, and production details
  • Providing such records upon request by Qlipps or legal authorities

Failure to comply may result in immediate termination and potential legal consequences.

9. ADVERTISER-FRIENDLY CONTENT GUIDELINES

Qlipps maintains advertising standards to ensure brand safety. Content falling into the following categories may not be eligible for advertising monetization:

  • Content depicting violence or physical harm in a graphic or disturbing manner
  • Content promoting dangerous or harmful activities
  • Hateful, derogatory, or discriminatory content targeting individuals or groups
  • Content involving recreational drugs or substance abuse
  • Firearms or weapons-related content in a non-educational context
  • Content addressing controversial or sensitive issues in an inflammatory manner
  • Coverage of tragic or sensitive real-world events
  • Content that enables deceptive, fraudulent, or dishonest behavior
  • Incendiary, abusive, or demeaning language or conduct
  • Tobacco or nicotine-related content

Such content may remain on the Platform but may be restricted from generating advertising revenue.

10. CONTENT MODERATION, AI ENFORCEMENT, AND VISIBILITY LIMITATION

Qlipps utilizes a combination of human moderation and automated technologies, including AI systems, to detect and enforce policy violations. These systems may analyze uploaded content, metadata, and user behavior.

Enforcement actions may include content removal, demonetization, account suspension, or visibility limitation. Visibility limitation refers to reducing the distribution or discoverability of content through ranking systems, recommendations, or search results. These measures may be applied without prior notice where necessary.

11. COPYRIGHT POLICY AND DMCA COMPLIANCE

Qlipps complies with the Digital Millennium Copyright Act (DMCA) and respects intellectual property rights.

  • If a valid DMCA takedown notice is received, Qlipps will remove or disable access to the allegedly infringing content.
  • The affected Creator will be notified and may submit a counter-notification if they believe the removal was incorrect.
  • If a valid counter-notification is received, the content may be restored unless the original complainant initiates legal action.
  • Repeat infringement may result in permanent account termination.

Creators are solely responsible for ensuring that they have all necessary rights and permissions for their content.

12. TAX OBLIGATIONS

Creators are responsible for determining and fulfilling their tax obligations, including reporting income and paying applicable taxes. Qlipps may request tax documentation and may report earnings to authorities as required by law.

13. TERMINATION AND ACCOUNT ENFORCEMENT

Qlipps reserves the right to suspend, restrict, or terminate Creator accounts for violations of these Terms, fraudulent activity, legal risks, or failure to comply with verification requirements.

Termination may result in removal of content, loss of platform access, and forfeiture of earnings where legally permissible.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Qlipps shall not be liable for indirect or consequential damages, including loss of revenue, data, or reputation, arising from your use of the Platform.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Qlipps from any claims, damages, or liabilities arising from your content, conduct, or violation of these Terms.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Illinois, United States, and disputes shall be subject to the jurisdiction of courts located therein.
